🐀 Rats, Roaches, and Bed Bugs — Your Rights

Pest infestations are your landlord's responsibility. Here's how to make them deal with it.

Your landlord must provide pest control

Under NYC Housing Maintenance Code, landlords are required to keep buildings free of pests. This includes rats, mice, roaches, and bed bugs. The landlord must hire licensed exterminators and treat the entire affected area — not just individual apartments.

    Bed bug specific rules

Under NYC's Bed Bug Disclosure Act, landlords must disclose bed bug history for the past year before signing a lease. They must also provide the HPD bed bug guide to new tenants. Treatment costs are the landlord's responsibility, not yours.

    Rat complaints

NYC has aggressive rat mitigation programs. File a 311 complaint for rat sightings. The city's rat inspection teams can issue violations and order landlords to seal entry points, improve sanitation, and hire exterminators.

    What to do

Document the infestation with photos and timestamps. Notify your landlord in writing. File a 311 complaint. If the problem persists, file an HP Action in Housing Court. Keep records of all pest control treatments (or lack thereof).
